These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and Stark Husky Platforms, a company incorporated under the laws of the Republic of Panama ("ConMigo," "we," "us," or "our") governing your access to and use of the ConMigo mobile application, website, and related services (collectively, the "Service").
By creating an account, downloading the app, or using any part of the Service, you confirm that you are at least 13 years of age (or 16 in the EEA), have read and understood these Terms, and agree to be bound by them and by our Privacy Policy, which is incorporated herein by reference.
ConMigo is a Spanish language learning application that provides:
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice to users.
To access the full features of ConMigo, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at contact@learnconmigo.app of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to maintain account security.
You must be at least 13 years of age to create an account. Users between 13 and 18 years of age represent that they have obtained parental or guardian consent to use the Service. We reserve the right to terminate accounts that violate this requirement.
You may maintain only one personal account. Creating multiple accounts to circumvent subscription limitations or other restrictions is prohibited.
ConMigo offers a free tier providing access to the first three units of the A1 curriculum, limited Habla con Migo sessions, and core gamification features. No payment information is required for the free tier.
ConMigo Pro is a paid subscription providing access to the full A1 curriculum (all 17 units), unlimited Habla con Migo sessions, the complete Knowledge Bank, detailed progress analytics, and all future A1 content updates.
Prices are subject to change with 30 days' notice. Applicable taxes may be added depending on your jurisdiction.
Subscriptions are billed through the Apple App Store or Google Play Store, depending on the platform you use. Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. You can manage and cancel your subscription through your App Store or Google Play account settings.
Refund requests are handled by Apple App Store or Google Play Store in accordance with their respective refund policies. ConMigo does not independently process refunds for app store purchases. If you believe you are entitled to a refund outside of app store policies, contact us at contact@learnconmigo.app and we will evaluate your request in good faith.
We may offer free trial periods for ConMigo Pro from time to time. At the end of a free trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial period ends.
You may use ConMigo solely for your personal, non-commercial language learning purposes in accordance with these Terms.

Violation of these prohibitions may result in immediate account termination and, where appropriate, legal action.
All content, features, and functionality of ConMigo — including but not limited to the application source code, curriculum text, vocabulary content, audio recordings, the Migo character design and persona, the Repaso Engine methodology, user interface design, graphics, and trademarks — are owned by Stark Husky Platforms, a company incorporated under the laws of the Republic of Panama or its licensors and are protected by copyright, trademark, patent (including patent-pending applications), and other intellectual property laws.
"ConMigo" and "Migo" are trademarks of Stark Husky Platforms. You may not use these marks without our prior written consent.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the ConMigo application on your personal device(s) solely for your personal language learning purposes.
You retain ownership of any content you submit to ConMigo (such as feedback or support messages). By submitting content to us, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and analyze that content solely for the purpose of improving our Service. We will never sell your content or use it for advertising.
If you provide us with suggestions, ideas, or feedback about the Service, you agree that we may use this feedback freely without any obligation to you.
ConMigo uses Google Gemini, a third-party large language model, to power Habla con Migo conversations and Repaso lesson generation. You acknowledge and agree that:
ConMigo is designed to support Spanish language learning and to align with CEFR A1 proficiency descriptors. However, we make no guarantee that use of the Service will result in any specific level of language proficiency, test score, academic credit, or employment outcome. Language acquisition depends on individual factors including study habits, prior experience, and time invested.
Any completion certificates issued by ConMigo are certificates of course completion within our platform and do not constitute officially recognized language certifications unless otherwise stated.
ConMigo integrates with third-party services including Google Gemini API, Supabase, Apple App Store, and Google Play Store. Your use of these services is governed by their respective terms of service and privacy policies. We are not responsible for the practices, content, or policies of third-party services.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT ANY ERRORS WILL BE CORRECTED.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CONMIGO, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50 USD, WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
You agree to defend, indemnify, and hold harmless ConMigo and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit through the Service.
You may terminate your account at any time by using the "Delete Account" feature in the app settings or by contacting us at contact@learnconmigo.app. Termination does not entitle you to a refund of any prepaid subscription fees except as required by applicable law.
We may suspend or terminate your account and access to the Service at any time, with or without notice, for conduct that we determine in our sole discretion violates these Terms, is harmful to other users, us, or third parties, or for any other reason. We will endeavor to provide advance notice of termination where reasonably practicable.
Upon termination, your right to use the Service ceases immediately. Sections 6, 8, 10, 11, 13, and 14 of these Terms survive termination.
These Terms are governed by and construed in accordance with the laws of the Republic of Panama, without regard to its conflict of law principles.
Before initiating any formal dispute, you agree to contact us at contact@learnconmigo.app and attempt to resolve the dispute informally. We will make good faith efforts to resolve the issue within 30 days.
If informal resolution fails, any dispute arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in the Republic of Panama. If you are a consumer in the EU or EEA, you retain the right to bring proceedings in the courts of your country of residence.
To the extent permitted by applicable law, you waive any right to bring claims against ConMigo as a plaintiff or class member in any purported class action or representative proceeding.
These Terms and our Privacy Policy constitute the entire agreement between you and ConMigo regarding the Service and supersede all prior agreements and understandings.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations freely, including in connection with a merger, acquisition, or sale of assets.
We may modify these Terms at any time. We will provide at least 14 days' notice of material changes via email or in-app notification. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance. If you do not agree to the revised Terms, you must stop using the Service.
